Pursuant to the California Public Records Act (California Government Code §§ 6250), I hereby request the following records:

A copy of the bid submitted in response to Amazon's request for proposals for the site of its second headquarters, any contracts with third-party providers for services rendered regarding the Amazon HQ2 bid, and any marketing budgets regarding Amazon-related expenditures from September 1, 2017 to the date this request is received.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Listed below is the response to your Public Records Act request. Please
feel free to contact me should you have questions or need clarification.

The City is in receipt of your email request of November 15 requesting a
copy of the City’s bid submission regarding Amazon HQ2. Please be advised
that this bid information is exempt from disclosure pursuant to Gov. Code
section 6255 as the public interest in the City maintaining a competitive
bid outweighs the interest in disclosure. As discussed by the California
Supreme Court in *Michaelis, Montanari & Johnson v. Superior Court* (2006)
38 Cal. 4th 1065, the disclosure of bid information prior to selection of a
winner and negotiation of an agreement would put the City at a competitive
disadvantage during the bidding process. This determination was made by
Jefferson Billingsley, Assistant City Attorney. This is not a denial of
your request, as soon as a selection is made by Amazon, or the City is
eliminated from the process, the City’s bid information will be provided to
you.
