Pursuant to the Illinois Freedom of Information Act., I hereby request the following records:

A copy of all agreements between the agency and the Drake Hotel Oak Brook related to the integration of the hotel's cameras into Oak Brook PD's Fusus network.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

On 12/17/2023 8:01:58 PM, the Village of Oak Brook received your written request for inspection or copying of the following Village public records described above. Please be advised that after a thorough search for the responsive records, it was determined by the the Police Department that no such agreements exist within the possession or control of the Village. Therefore, no records exist. Please do not hesitate to reach out with questions or concerns.

2.             Denial of Request

Your request is denied as to the records described above for the following reason.
X        The Village does not have any public records in its possession or control, or in the possession of a party with whom the Village has contracted to perform a government function and that directly relate to the government function, that are responsive to your request. §1, §2(c), § 7(2)
Applies to: all agreements between the agency and the Drake Hotel Oak Brook related to the integration of the hotel's cameras into Oak Brook PD's Fusus network.

A. Responsible Official.  The Village’s FOIA Officer is the official responsible for this denial.

B. Notice of Right to Review by Illinois Attorney General.  You have the right to file a request for review of your request and this Notice of Denial by the Public Access Counselor of the Office of the Illinois Attorney General.  The Public Access Counselor may be contacted at 500 South 2nd Street, Springfield, Illinois 62701, by telephone at (877)299-3642 or by email at public.access@ilag.gov.
C. Notice of Right to Judicial Review.  Under Section 11 of the Illinois Freedom of Information Act, 5 ILCS 140/11, you have the right to seek judicial review of this denial.  The Village cannot advise or represent you in this matter.  You should consult your own legal counsel.
