Mr. Tracey,

Thank you for your 4/23 FOIA request. In speaking to our Police Records Division, there are no existing records that are responsive to your request. Per Attorney General's Opinion 96-IB28, "FOIA does not require a public body 'to create a record' where the requested record does not exit, nor does FOIA require a public body 'to compile the requested data from' other public records that may exist." This opinion can be found on the Attorney General's website here: https://attorneygeneral.delaware.gov/1996/08/08/96-ib28-re-freedom-of-information-act-complaint-against-sussex-county-planning-and-zoning-office/. If you have any questions, please let me know. With this email, your request is considered closed.
