In my prior dealings with city agency FOIL requests, I have seen the city proffer dates 60 days ahead as the expected completion date, only to further delay by 60 days on that date. More than one agency illegally repeated this at least a half dozen times.

Can I expect this FOIL request to actually be completed on or before Tuesday, January 2, 2024? If not, I will not hesitate to appeal on grounds of constructive denial.

It has been approximately 12 business days since my November 20 communication requesting confirmation that Tuesday, January 2, 2024 is the honest, sincere, intentional, and realistic completion date for this request.

Let the record reflect that I am attempting to work with the agency in good faith, and give them opportunities to comply with the letter and spirit of the law.

Absent further confirmation, I think it's reasonable to assume the agency shall produce responsive documents on or before Tuesday, January 2, 2024, to meet their own schedule. If documents are not produced by then, or if the estimated completion date is extended further, I will not hesitate to appeal on grounds of constructive denial.
