Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

The following documents regarding FOIL # 13-1 and 13-2, submitted to and received by the Manhattan Borough President's office by Erin Durkin of the New York Daily News on 1/03/13 and 1/09/13, respectively. The requested sought, respectively, schedules and expense reports from the office.

-- Correspondence between Erin Durkin and the office
-- Processing notes and internal communications regarding the requests
-- Documents released per the requests

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

We are in receipt of your FOIL request dated Sunday, June 1, 2014 regarding the responses of the Manhattan Borough President's Office to two FOIL requests in 2013. (13-1 and 13-2.)
Please be advised that we will search the office records and provide you with copies of those FOIL requests and correspondence relating thereto. However, we will not be releasing any internal office notes or internal communications.

We estimate that this search and production will require approximately 90 business days to complete. We will attempt to transmit all documentation electronically.

In response to your question, following up, on your June 1, 2014 request. I already responded with an estimate of the time required for response. I have, however, gathered the documents responsive to your requests for records pertaining to FOIL Numbers 13-1 and 13-2, and we are ready to provide them to you.
The records of FOIL 13-01 consist of 132 pages.
The records of FOIL 13-2 consist of 4 pages.
I will be happy to forward to you pdf's of these documents upon receipt of your payment of $34.00 (136 pp @ .25). Waiver of this fee will only be considered upon receipt of proof of your non-profit status.

The Office of the Manhattan Borough President continues to receive numerous FOIL requests. Unfortunately, our office does not have the staff or resources to comply with these requests without seeking the compensation provided therefor in the FOIL Statute, POL ยง87.1(b)iii.
I suggest you seek reimbursement from the newsgathering organization for which you work.
Please let me know your decision on the FOIL as soon as you can.
