Pursuant to the New York Freedom of Information Law, I hereby request the following records:

Copies of all "critical incident reports" filed to OTDA that took place at the 30th Street Men's Shelter in Manhattan, the Franklin Women's Shelter in Bronx, and the Help Women's Center in Brooklyn between January 1, 2022 and April 11, 2022.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

We will need to determine the availability of all records responsive to your request and review these records for their releasability under the FOIL law and its exceptions. Please be advised that due to the volume of such requests being processed by our office, you may experience delays in our ability to respond. Dear Ms. Hogan,

I write in further response to your FOIL request submitted April 18, 2022, seeking:

“Copies of all "critical incident reports" filed to OTDA that took place at the 30th Street Men's Shelter in Manhattan, the Franklin Women's Shelter in Bronx, and the Help Women's Center in Brooklyn between January 1, 2022 and April 11, 2022.”

Please be advised that the agency does not maintain records in a manner and format that permits a diligent search for responsive materials. Specifically, the agency is unable to isolate with reasonable effort which individual incident reports were “filed to OTDA.” See Public Officers Law §87(3)(a), requiring database information retrieval or extraction under circumstances in which it can be done with reasonable effort. Note that the New York State Office of Temporary and Disability Assistance likely maintains the records in a manner allowing for a focused search for the requested materials.
