Pursuant to the New York Freedom of Information Law, I hereby request the following records:

1. Excel document with list of supportive housing units converted from hotels in New York City, with their address, borough, how many individuals serviced in facility, occupancy, and corresponding service provider.
2. Excel document with list of hotels DHS/DSS plans to convert from hotels into supportive housing or shelters, with their address, borough, and corresponding service provider.
3. Document with information about shelter occupancy, including address of shelter, number of beds, and number of beds available/occupied.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

1. Excel document with list of hotels DHS/DSS plans to convert from hotels into supportive housing or shelters, with their address, borough, and corresponding service provider.

1. Document with information about shelter occupancy, including address of shelter, number of beds, and number of beds available/occupied.

Before a determination can be rendered, further review is necessary to assess the potential applicability of exemptions set forth in FOIL, and whether the information can be located. Please be advised that this office receives numerous requests per month, which causes delays in our ability to respond to each request. Therefore, we estimate that we will be able to respond further to your request within 90 days of this letter.

I write in further response to your FOIL request submitted February 23, 2022, seeking the below information. Please see the following responses:

1. "Excel document with list of supportive housing units converted from hotels in New York City, with their address, borough, how many individuals serviced in facility, occupancy, and corresponding service provider. Please be advised that because this information is not uniformly tracked in a central list or system, the agency does not maintain responsive records in a manner that permits a diligent search or production with reasonable effort. Please see NY Public Officers Law ("POL") §89(3) and NYS Committee on Open Government opinion FOIL-AO-18949.

1. Excel document with list of hotels DHS/DSS plans to convert from hotels into supportive housing or shelters, with their address, borough, and corresponding service provider. Please be advised that responsive records, to the extent they exist, are withheld pursuant to NY POL §87(2)(c) as records which, if disclosed, would impair present or imminent contract awards; as well as POL §87(2)(g) as records with are intra/inter-agency materials which are not statistical or factual tabulations or data, final agency policy or determinations, instructions to staff that affect the public, or external audits.
