Pursuant to the New York Freedom of Information Law, I hereby request the following records:

I hearby request copies of all complaints filed with the NYC Human Rights Commission under the city's new pay transparency law beginning from Nov. 1 2022 through Jan 1 2023.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Ms. Hogan: You withdrew your previous request (FOIL-2022-226-00348) on 11/17/2022 and I closed the matter. Notice of same was sent to you via the City's OpenRecords system on that date. If you would like to submit a new request, please confirm.

As I explained to you before, I do not know whether or not there are responsive records; however, to the extent you are seeking records of open investigations, your request would be denied pursuant to FOIL 87(2)(e)(i) and (e)(ii). These provisions apply where records are compiled for law enforcement purposes and their disclosure would interfere with law enforcement investigations or deprive a person of a right to a fair trial or impartial adjudication. Given that the salary transparency provisions only took effect on November 1, 2022, complaints filed since then (if any) are likely still under investigation and subject to FOIL 87(2)(e)(i) and (e)(ii). You are of course free to submit a new request, but I do want you to be aware that the records you are seeking (if any exist) could turn out to be exempt.
