From: Department of Education

The Department of Education (DOE) has denied your FOIL request FOIL-2023-040-00080 for the following reasons: (https://a860-openrecords.nyc.gov/request/view/FOIL-2023-040-00080)
Your request under the Freedom of Information Law (FOIL) is denied. Please see the attached determination letter. This letter is in final response to the above-referenced Freedom of Information Law (FOIL) request. On February 22, 2023, the Office of Legal Services of the NYC Department of Education (DOE) received your Freedom of Information Law (FOIL) request (submitted February 21, 2023) through the OpenRecords portal, which assigned it an OpenRecords reference number of 2023-040-00080 .  The DOE has assigned it a FOIL reference number of F21,340. Please be advised that we will be closing the request F21,340 because this request is identical to a previously submitted request that is being processed by the FOIL Unit under reference number F21,336. Where there is no change in circumstances between two identical requests, an agency may properly deny the second request. See FOILAO-8279 (June 1, 1994). As such, the instant request is denied as duplicative of a prior request. However, please note that we continue to process your previous request under F21,336. When submitting additional correspondence, please use reference number F21,336 This concludes the FOIL Unit’s response to F21,340, and this request will be marked as “closed” in the Unit’s database as of the date of this letter.
Please visit FOIL-2023-040-00080 to view additional information and take any necessary action. You may appeal the decision to deny access to material that was redacted in part or withheld in entirety by contacting the agency's FOIL Appeals Officer: (https://a860-openrecords.nyc.gov/request/view/FOIL-2023-040-00080) foil@schools.nyc.gov within 30 days.
