Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

All records dating from April 2011 to present that pertain to serious criminal incidents and those that involve death, weapons or fire/hazardous conditions that were reported by the University at Albany's University Police Department to the office of the assistant vice chancellor for university police in a timely manner per SUNY Police Manual § 35.06.

It seems necessary to note that the above is not a duplication of a request I've ever made to the University at Albany, that it is a specific and not overbroad request, and that it is, as the SUNY Police Manual indicates, the sort of information meant to be maintained at SUNY System Administration.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Mr. Philippo,

Per your FOIL request for “all records dating from April 2011 to present that pertain to serious criminal incidents and those that involve death, weapons or fire/hazardous conditions that were reported by the University at Albany's University Police Department to the office of the assistant vice chancellor for university police in a timely manner per SUNY Police Manual § 35.06,” please be advised that after a thorough search it has been determined that there are no documents responsive to your request. We are advised of serious incidents via phone and e-mail and these communications are intra-agency, non-final materials which are exempt from disclosure under §87(2)(g) of New York’s Public Officers Law.
