Pursuant to the New York Freedom of Information Law, I hereby request the following records:

1. I would like to get the complete disciplinary record and any records of citizen or administrative complaints made against Officer Miguel Rondon of Triborough Bridge Tunnel Authority, New York Division of Criminal Justice Services (NCJS), to include but not limited to all information relating to the disciplinary process that had commenced while the officer left the agency.
2. Any and all information related to decertification number 1633467008 - 428148716.
3. Any and all of Officer Rondon's payroll information during his tenure with the agency.
4. Any and all paperwork related to Officer Rondon's attendance during his tenure with the agency (for example, times when he called out, went on vacation, departed his shift early, or arrived to his shift late, no call/no show).
5. Any and all information relating to the drafting and completion of the official statement regarding Officer Rondon's departure from the agency.
6. Any and all information relating to Officer Rondon's performance evaluations during his tenure with the agency.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Personnel records of Triborough Bridge and Tunnel Authority (TBTA) bridge and tunnel officers, sergeants, and lieutenants are used to evaluate the performance of those employees toward continued employment or promotion are exempted from disclosure by New York State Civil Rights Law §50- e, subsection 2, which provides that such records “shall be disclosed in a court action pursuant to the relevant provisions of the criminal procedure law, the civil practice law and rules, or any other provision of law governing such disclosure only after the court has notified the subject of such record that such record may be disclosed in a court action and the court has given the subject of such record an opportunity to be heard on the question of whether the records sought are relevant and material in the action before the court.” Therefore, responsive records are denied.

Responsive records to item numbers 2 and 5, do not exist in our files.

In accordance with Title 21, New York Code of Rules and Regulations §1001.7, you are entitled to appeal this determination within thirty (30) days.
