Pursuant to the New York Freedom of Information Law, I hereby request the following records:

Any policies, procedures, or other documentation that would influence when ICE conducts investigations related to non-immigration related crimes, suspected crimes or other incidents. In other words, any document that defines when an ICE investigation or other law enforcement action is triggered, besides those conditions that are related to suspects' immigration status. Additionally, please include any policies or procedures that define rules or guidelines for how such investigations are to be conducted by ICE personnel, including *but not limited to* investigative procedures, how personnel are assigned, the criteria for closing an investigation, and any other relevant aspects of how an ICE investigation is conducted.

If a record meets the above request but includes both non-immigration related *and* immigration-related policies or procedures, please consider it included in the scope of this request.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

After reviewing our records we discovered that this request was administratively closed due to no response to correspondence sent to you. In conducting a search for responsive records, the ICE FOIA office has determined that further clarification is needed regarding your request. In order to conduct an adequate search, could you provide us with the specific types of investigations that you are interested in and a date for search. Please provide the ICE FOIA office with a response as soon as possible to avoid any further delay in the processing of your request. If a response is not received within 30 days, your request will be administratively closed.

Good day,

The original case was opened under ICE FOIA Case Number 2020-ICFO-33071. We sent a request for clarification to you on April 20, 2020 and we did not have any record of receiving a response, so that case was closed at that time.

Based on your below email a new case has been reopened under 2022-ICFO-14934 you should have received an acknowledgment letter for that. Currently we are conducting a search for responsive records to your request. Once responsive records are located it will be assigned to a FOIA analyst and processed and a response will be provided to you as soon as possible.

While a program office is searching for records it is possible they might need clarification on exactly what records you are looking for. If you could provide a more specific description or narrow down your request in any way it would be very helpful. Since they came back with a request for clarification the first time we are anticipating they might do this again, so any further clarification you could provide should allow us to be more efficient in fulfilling your request.
