Pursuant to the above referenced FOIL request, an agency may deny access to records that “are trade secrets or are submitted to an agency by a commercial enterprise or derived from information obtained from a commercial enterprise and which if disclosed would cause substantial injury to the competitive position of the subject enterprise”. Responsive documents containing proprietary, financial or trade secret information have been denied in accordance with §87(2)(d) of the Public Officers Law.

To Whom It May Concern: Pursuant to the New York Freedom of Information Law, I hereby request the following records: All digital art files prepared by Kiki Smith for the creation of murals at Grand Central Madison. I ask that the files be released in the same format they were provided by the artist, be it PDF, Adobe Illustrator or some other digital vector format. The requested documents will be made available to the general public, and this request is not being made for commercial purposes. In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not. Thank you in advance for your anticipated cooperation in this matter.
