Pursuant to the New York Freedom of Information Law, I hereby request the following records:

A copy of the source code for the "MYmta" Apps available for iOS and Android operating systems. If a version control system (for example, Git or CVS) was employed during development, I additionally request a complete copy of all version control history for the apps' source code.

I also request any contracts with third parties to develop, test, or run security audits on these applications, as well as any specifications for the apps' user interface or functionality intended to be referenced during the development of the application.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Dear Mr. Jordan:

This is in response to your request under Freedom of Information Law (“FOIL”) to obtain copies of records. The Authority has identified documents that may be responsive to your request, but those documents are determined to be Security Sensitive Information (SSI). Under Public Officers Law §87 (2)(i), such information is exempt from disclosure because if disclosed, would jeopardize the capacity of an agency or an entity that has shared information with an agency to guarantee the security of its information technology assets, such assets encompassing both electronic information systems and infrastructures. Therefore, your FOIL request is denied.

In accordance with Title 21, New York Code of Rules and Regulations §1001.7, if you wish to file an appeal regarding this determination, you may do so within thirty (30) days from this correspondence by sending a written appeal to: Patrick Warren, Chief Safety Office, Metropolitan Transportation Authority, 2 Broadway, 20th Floor, New York, New York 10004.
