Pursuant to the Florida Sunshine Law, s. 286.011, F.S., I hereby request the following records:

The current roster and documents and records containing photos of all Volusia County Sheriff's Deputies (as well as the Sheriff himself) as of the date this request is processed.

These records should be sufficient to show:

Full Name (to avoid confusion of officers with the same last name)
Photo or Headshot
Current badge number
Current rank
Unit assignment
Gender
Race
Date of employment
Government email address
Salary
Disciplinary action/Corrective action/Complaints against each deputy (and including the Sheriff himself)

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Good morning: There is no existing record that is responsive to your request. The Sunshine Law provides for a right of access to inspect and copy existing public records. However, the Florida Attorney General has advised the Sunshine Law does not mandate that the custodian give information from records nor does it mandate that an agency create new records to accommodate a request for information.

It is actually a valid request and multiple law enforcement agencies have compiled. There’s no rationale or basis that you have given to refuse these records.

Logically, if no such records exist, then it also means that there’s no sworn deputies at Volusia County Sheriff’s Office which is definitely not true.

Please provide clarification for your refusal.

The Florida Public Records Act requires you to undertake reasonable efforts to locate responsive records and to work in good faith with requesters to respond to their request. Thus, under the Florida Public Records Act, you are obligated to conduct a reasonable search and cannot deny a request merely because it might generate a large volume of records.

I ask that you please respond to this request within 5 business days either by providing all the requested records or by providing a written response stating the legal authority on which you rely in withholding any document, as well as stating when documents will be made available. Should you choose to withhold or reject this request, we ask that you provide an explanation of why your agency's response is different from the many others that have complied with our request.

I also request that any records maintained in an electronic format be provided in that same format (such as a PDF, CSV, or XLS file), to avoid copying costs.

However, should you be unable to do so, I will reimburse you for the direct costs of copying these records (if you elect to charge for copying) plus postage.
