Pursuant to the Texas Public Information Act , I hereby request the following records:

A log of public records requests submitted to the Health and Human Services Commission that lists the date of request, the requester's name, the requester's organizational affiliation, a description of the request and the date the request was filled. Ideally I would like this information for the period from 2004 to the present.

The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, and is made in the process of academic research and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Mr. Peterson, this is to acknowledge receipt of your open records request.
I can tell you at this time that our Open Records Log was not designed with public access in mind and that it contains confidential information (such as identities of Medicaid, SNAP, and TANF clients) that will have to be reviewed and redacted before the log can be released.
Since January 1, 2004, the Commission has received 9318 open records requests. Because of the breadth of your request, we will definitely have to charge you for the employee time ($15.00 per hour) it would take us to review and redact the confidential information.
We will provide you with a cost estimate within the next ten business days. In the meantime, you might want to consider narrowing the scope of your request to reduce your costs.

Ok, sorry, one more clarification on the data we have. You asked for “the date the request was filled.” We have the date that the file on the request was closed, but that date does not reflect whether the requested information was provided or if it was withheld in accordance with our state’s open records law. Does that cause a problem for you?

That doesn't cause a problem, the closure date is fine.

Is there any indication in the tracking system of whether or not the requested information was provided? I would appreciate that indicator being included in the spreadsheet, but no problem if that isn't something that's tracked.
