Hello,

I am writing in response to the rejection of FOIA request NFP-130739.

I was instructed to contact you to ask for advice on how to reasonably describe my request.

My request asked for the total number of FBI agents, staff, and employees that were found to be involved in activity related to "LOVEINT" or "love intelligence" (the intentional use of technology resources and privileges by intelligence officials to eavesdrop on and/or surveil love interests, spouses, partners, exes, etc.) between 1/1/2011 and the present date, aggregated by year, and whether or not any administrative or disciplinary action was taken in those situations. (For clarification about the specific activity I am referring to, refer to the following article: https://www.nbcnews.com/news/world/loveint-nsa-letter-discloses-employee-eavesdropping-girlfriends-spouses-flna8C11271620).

I was told in my FOIA rejection letter that the requested subject matter is not searchable in the FBI system. Can you please offer some suggestions for wording this request in a way that is deemed reasonable in order to access this information?

Thank you.

From: Federal Bureau of Investigation

The FOIPA does not require federal agencies to answer inquiries, create records, conduct research, or draw conclusions concerning queried data. Rather, the FOIPA requires agencies to provide access to reasonably described, nonexempt records. The question posed is not a FOIPA request because it does not comply with the FOIPA and its regulations.

Please resubmit your FOIPA request for the specific information you are requesting, rather than asking questions and your request will be forwarded to Initial Processing for review. Information regarding the Freedom of Information Act/Privacy is available at http://www.fbi.gov/foia/. Note: The foipaquestions@fbi.gov email address is not the proper submission method for new FOIPA requests.

You may submit your request electronically at https://efoia.fbi.gov (available 24 hours a day), fax it to 540-868-4997, or mail it to FBI, Attn: FOIPA Request, 200 Constitution Drive, Winchester, VA 22602-4843. Please be sure to include your contact information, to include complete mailing address, on any correspondence.

Respectfully,

Hello,

In my FOIA rejection letter for request NFP-130739, which was dated August 26, 2021 and sent to me by Michael G. Seidel, Section Chief of the Record/Information Dissemination Section of the Information Management Division, I was instructed to contact you -specifically- to ask how to reasonably word my revised request.

In that letter, Mr. Seidel wrote, "For questions on how to reasonably describe your request, please email us at foipaquestions@fbi.gov. You may also visit www.fbi.gov and select “Services,” “Information Management,” and “Freedom of Information/Privacy Act” for additional guidance."

Since your office is FOIPAQUESTIONS@FBI.GOV, it appears to be the correct email address to ask FOIA questions, given Mr. Seidel's specific instructions to me.

That said, can you please offer guidance on how to reasonably word my next request related to this matter?

Thank you,

Erin Miller
