The NYC Commission on Human Rights (CCHR) has closed your FOIL request FOIL-2019-226-00102 for the following reasons: (https://a860-openrecords.nyc.gov/request/view/FOIL-2019-226-00102)
July 11, 2019 By Electronic Mail: requests@muckrock.com Jpat Brown Re: FOIL Request No. 2019-226-00102 Dear Jpat Brown: In my capacity as Records Access Officer (“RAO”) of the New York City Commission on Human Rights (“Commission”), I write concerning the above referenced FOIL request. For the reasons set forth below, your request is denied. FOIL Request By direct entry into the City’s OpenRecords system on May 9, 2019, you submitted a request for records pursuant to the Freedom of Information Law, Art. 6, New York Pub. Off. Law (“FOIL”). In that request, you sought “ All "Fair Housing NYC" complaints (see: https://www1.nyc.gov/site/fairhousing/renters/file-a-complaint.page) received from January 1st, 2014 to this date.” Responsive Records May Exist but are Exempt from Disclosure To the extent you are seeking records of matters currently under investigation, and without confirming or denying their existence, such records, if the Commission possessed them, would be exempt from disclosure under the New York Freedom of Information Law §§ 87(2)(e)(i) and (e)(ii). These provisions apply where records are compiled for law enforcement purposes and their disclosure would interfere with law enforcement investigations or deprive a person of a right to a fair trial or impartial adjudication. Accordingly, your request is denied to the extent you seek records of matters currently under investigation. No Responsive Records Exist Given the weblink included in your request, I have construed your request to mean that you are seeking housing complaints filed online. I can confirm after a reasonable and diligent search that no such records were found. Accordingly, your request is denied. You may appeal this decision to the Commission’s Records Access Appeal Officer, Lesley Berson Mbaye, within 30 days. She may be reached at foilappeals@cchr.nyc.gov Rudolph A.
