Pursuant to the Freedom of Information Act, I hereby request the following records:

The emails to or from David Neal, Chairman of the BIA, since January 1, 2017 mentioning the phrase "special project"

Please produce the records related to the existence of a list of special projects cases, which should include the list of current special projects cases.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

The agency did not conduct an adequate search. The agency does not indicate it searched the BIA chairman's e-mails dating back to 1/1/17. It also does not indicate whether it used the search term "special project" which would be inclusive of the plural phrase "special projects." Given that the BIA's routing slip contains an option stating a file is "needed for immediate adjudication as a 'special projects' case as identified by the chairman," it is does not appear to be possible that there are no email messages to or from the chairman mentioning that phrase. To that extent the agency appears to have withheld responsive non-exempt records.
