This request includes any and all Allegation Receipt Forms, Branch Evaluation, Plan, and Recommendation documents, Corrective Action Program entries, security shift logs, emails, memorandums, camera footage, official reports, bulletins, and any and all other responsive records. The time frame for this request includes all responsive records from September 2, 1974 up to and including the date this request is officially processed.

Please include all processing notes related to this request.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

We have now received the cost estimate for the search time and duplication costs associated with the processing of your four (4) January 19th 2022 and January 20th 2022 FOIA requests, NRC-2022-000064, 2022-000065, 2022-000068 and 2022-000069. As we explained in our acknowledgement letter dated January 21, 2022, we have aggregated these requests for fee purposes. The program/regional office(s) involved have estimated that a total of 3 hours of search time will be necessary to complete your requests, which is expected to result in the release of approximately 62 pages.

Because you are a "non-excepted" requester, you are responsible for search time in excess of two hours and duplication costs above 100 pages. Duplication costs are not expected as you have requested that we furnish the records to you electronically. As such, as reflected in the attached Form 509, Statement of Estimated Fees, your final cost is estimated to be 3 hours x $87.12/hour = $261.36, which accounts for the professional search time at the GS14, Step 7 level, and as explained to you in the "Explanation of Fees" page attachment to the [date] acknowledgment letter we sent you, and as required pursuant to 10 C.F.R. 9.37.

Pursuant to 10 C.F.R. 9.40(e), we will not continue processing your request until we receive a response from you of your willingness to pay up to the above-referenced fee estimate. Additionally, because the estimated fee exceeds $250, the NRC will not process your request without advance payment of the estimated fee. We have attached a Form 629, Authorization for Payment by Credit Card, should you choose to remit the estimated fee by credit card. Alternatively, you may remit payment at www.pay.gov<http://www.pay.gov> by checking the box "Other" and entering the FOIA request's reference number.

If we have not received a response from you by February 15, 2022, we will administratively close your request. You may also narrow the scope of your request to reduce the estimated fees associated with the processing of your request.

Please consider this a formal appeal pursuant to the Freedom of Information Act, regarding NRC-2022-000064; NRC-2022-000065; NRC-2022-000068; and NRC-2022-000069, that sought:

Any and all records pertaining to sightings of Unidentified Flying Objects (UFOs), also known as Unidentified Aerial Phenomenon (UAP), at or in the vicinity of the Three Mile Island Nuclear Generating Station, Susquehanna Steam Electric Station, Limerick Generating Station, and Peach Bottom Atomic Power Station. This request includes any and all Allegation Receipt Forms, Branch Evaluation, Plan, and Recommendation documents, Corrective Action Program entries, security shift logs, emails, memorandums, camera footage, official reports, bulletins, and any and all other responsive records.

The time frame for these requests encompasses June 1, 1967 up to and including the date these requests were officially processed.

In a letter (attached) dated February 23, 2022, the Nuclear Regulatory Commission stated that no responsive records related to the aforementioned case numbers were found, despite initially indicating in an email (also attached) dated February 2, 2022, relating to a fee estimate that totaled $261.36, that these requests were "expected to result in the release of approximately 62 pages." No adequate explanation has been given for this discrepancy.

Following the NRC's February 23 note, the FOIA officer solicited a phone call with this requester in order to clarify the keyword scope of these requests (on behalf of program offices, who apparently requested this clarification). It was agreed upon that the search would essentially be conducted using the language included in the original requests; yet, no responsive records were located.

The NRC's program offices performed an inadequate search for records responsive to these requests. I respectfully ask that the NRC conduct new complete and thorough searches for records related to these requests, using the key words that initially located some 62 pages of responsive records, and that these searches include, but not be limited to, text searches of Electronic Case Files (ECF). This new search should also include, but not be limited to, searches of/for main file records and cross-reference records. Before litigating this matter, I am open to mediation with these requests through the Office of Government Information Services (OGIS), if necessary.

I would appreciate a response to this administrative appeal within 20 business days, as required by the statute. Please do not hesitate to contact me should you have any questions concerning this appeal. I greatly appreciate your time and attention in this matter.
