Dear Mr. Meadors:

Thank you for submitting your Freedom of Information Act (FOIA) request,
dated August 29, 2021, to the National Archives and Records Administration
(NARA) via the FOIAOnline website. We received your request on August 30,
2021. Your request concerns DD 1300 Casualty Reports for service members
killed on board the* USS LIBERTY* in 1967.

Our office uses the FOIAonline portal for FOIA and Privacy Act requests for
the National Archives and Records Administration's operational records
(records created by this agency). Because your FOIAOnline request is for
records that may be textual archival records (records created by or
originated in a different agency but that may have been transferred to the
legal custody of NARA), we have forwarded it to our regional archive, *The
National Archives at St. Louis, MO *which holds Navy Individual Deceased
Personnel Files (IDPFs) for the time period you requested.

Since NARA St. Louis does not process FOIA requests through FOIAOnline, we
removed your request from the FOIAOnline website. That facility will
assign you a new tracking number, and respond directly to you. In the
future, if you need to follow up with the staff there, please contact them
at the address below, or electronically via email (email is preferred).

about FOIA. On our main website, www.archives.gov, you can learn more
about the resources we offer to the public, and you can access our online
catalog.

Due to the COVID-19 pandemic, and pursuant to guidance received from the
Office of Management and Budget (OMB), NARA has adjusted its normal
operations to balance the need of completing its mission-critical work
while also adhering to the recommended social distancing for the safety of
our staff. As a result of this re-prioritization of activities, you may
experience a delay in receiving a substantive response to your FOIA
request. We apologize for this inconvenience and appreciate your
understanding and patience.

While you are waiting to hear from NARA St. Louis, you may wish to search
one of our online databases, an electronic records series called "Defense
Casualty Analysis System (DCAS) Extract Files, created ca. 2001 -

Joe Meadors-

Thank you for contacting the National Archives at St. Louis.

We have received your request concerning the USS Liberty. For an Archival
request we can offer a search for a Navy Individual Deceased Personnel File
for each individual you listed. These files generally carry the DD Form
1300 as well as other documents. However, what is in the file can not be
guaranteed.

The National Archives and Records Administration has begun to phase
reproduction and digitization services back in. However, at this time we
are only servicing Burial, Medical Emergency, and Employment requests. Any
other orders will be placed in the queue and serviced in the order
received. We apologize for any inconvenience.

The National Archives will decide when to begin reopening our facilities
based on guidance from the federal government, including the Office of
Management and Budget (OMB), the Centers for Disease Control (CDC), and the
Office of Personnel Management (OPM). We are working diligently on our
plans for the gradual reopening of our facilities across the country. The
reopening plans will be based on local conditions for each geographic area
and OMB and OPM Memorandum M-20-23, Aligning Federal Agency Operations with
the National Guidelines for Opening up America Again. These plans will be
implemented in three gradual phases, which will likely last several weeks
or even months, based upon local conditions in the respective community.
Even as we begin to reopen, operations may be curtailed due to limited
staffing or the need to temporarily close facilities for cleaning. Please
understand the protection and safety of our staff, volunteers, and the
public remain our top priority. We will provide further information as it
is available - please monitor our web page https://www.archives.gov/st-louis

Unfortunately, we are still gearing all our resources to assisting the
National Personnel Records Center with their backlog of emergency requests
- requests from living veterans and their families who are in need of
burial, medical care, employment and the like.

We have begun to phase reproduction and digitization services back in.
Orders are placed in the queue and serviced in the order received. Due to
the increase in correspondence, a substantial backlog, emergency requests,
and the limitation of staff time available to answer correspondence, we are
unable to provide a timeframe for an answer to be given -we apologize for
any inconvenience. We will provide further information as it is available
- please monitor our web page https://www.archives.gov/st-louis for future
developments.

We do not currently have a timeline as to when we'll be able to resume our
regular correspondence and thank you for your continued patience.

Sincerely,

Ms. Corey S. Stewart

Archivist

Subject: 2-25530816648 FOIA cases

On Sept. 2, 2021:
Subject: Fwd: FOIA Request Deletion: NARA-NGC-2021-001330
Dear Mr.

For your reference, a copy of your request and your attached list of
service members are below.

On our website at www.archives.gov/foia you can find further information

4/29/2008, documenting the period 6/28/1950 - 5/28/2006 - Record Group
330." This is available at

<

Joe-

I was forwarded a message from our FOIA officer concerning the case listed
in the subject line. This case was for a Navy IDPF for Edward Emory
Rehmeyer III.

Unfortunately, NARA does not receive appropriated funds from Congress for
responding to requests forphotocopies of accessioned records. Therefore, we
are required to collect reproduction fees from the requester. The fees are
authorized under the official regulations found in Title 44 Section 2116 of
the U.S. Code (44 USC 2166). The National Archives Trust Fund Fee Schedule (
http://www.archives.gov/research/order/fees.html) contains a list of all
established fees.

If you need a new invoice please let me know and I can get a new one sent
to you.

If you are not satisfied with our action on this request, you have the
right to file an administrative appeal within ninety (90) calendar days
from the date of this letter via regular U.S. mail or email. By filing an
appeal, you preserve your rights under FOIA and give the agency a chance to
review and reconsider your request and the agency’s decision. If you
submit your appeal in writing, please address it to the Deputy Archivist of
the United States (ND), National Archives and Records Administration, 8601
Adelphi Road, College Park, Maryland 20740. Both the letter and the
envelope should be clearly marked “Freedom of Information Act Appeal.” If
you submit your appeal by e-mail please send it to FOIA@nara.gov, also
addressed to the Deputy Archivist of the United States. Please be sure to
explain why you believe this response does not meet the requirements of the
FOIA. All correspondence should reference your case tracking number
[2-26459051767].

If you would like to discuss our response before filing an appeal to
attempt to resolve your dispute without going through the appeals process,
you may contact our FOIA Public Liaison Theresa Fitzgerald, for assistance
