To Whom It May Concern:

Pursuant to the Alabama Public Records, I hereby request the following records:

A list of all donors and the amount donated by each donor to the Alabama School of Cyber and Engineering Foundation Inc. (ASCTE Foundation), the 501(c)(3) non-profit corporation established in January 2018 to benefit the Alabama School of Cyber Technology and Engineering, a state of Alabama-funded, state-wide, grade 9-12 magnet school located in Huntsville, Ala.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days.

Sincerely,

Taylor Barnes

Dear Mr. Barnes,

Your request under the Alabama Open Records law (Ala. Code ยง 36-12-40) was forwarded to our office for a response. Your request was for a list of "all donors and the amount donated by each donor to the Alabama School of Cyber and engineering Foundation Inc. (ASCTE Foundation), the 501(c)(3) non-profit corporation established in January 2018 to benefit the Alabama School of Cyber Technology and Engineering, a state of Alabama-funded, state-wide, grade 9-12 magnet school located in Huntsville, Ala."

I noticed that your request appears to be from Massachusetts, which prompts me to point out that Alabama's Open Records law only permits "every citizen" to inspect and make a copy of public documents. Alabama courts and the Alabama Attorney General's Office have interpreted this to mean that the right of access to most public records applies only to citizens of Alabama. E.g., Ala. Op. Att'y Gen. No. 2018-030.

Regardless, I do not believe that the Alabama State Department of Education (ALSDE) would have documents that would be responsive to your request. The donors and amount donated by each would be a record presumably maintained by the non-profit you mentioned in your request, not the ALSDE.

Sincerely,

James R. Ward
