Pursuant to the The Missouri Sunshine Law, I hereby request the following records:

Email messages from any ICE employee to any Morgan County Sheriff’s Department employee in 2019.

You can fulfill this request by searching the primary contacts who have interacted with ICE regarding immigration detainees at the Morgan County Jail. Searching for “@ice.dhs.gov” between 1/1/19 and 12/31/19 should provide all responsive documents.

I am a member of the news media and request a waiver of all search and production fees. I am writing a news article on the relationship between Morgan County and ICE.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

This email is an acknowledgement of your Sunshine Law Request for records dated February 5, 2020. The Morgan County Sheriff's Office received your records request on February 5, 2020, via email only, and has reviewed your request. I am happy to get you the information requested; however, pursuant to RSMo §610.026.2, and Morgan County Commission Resolution 050918, Morgan County will require payment of copying fees and duplication time prior to producing the documents.

Per the Morgan County Resolution 050918, our average hourly rate for clerical staff is $13.55 with $0.10 per copied page for documents. The Sheriff's Office estimates that it will take approximately 40 hours to complete the research with approximately 600 copied pages. As such, if you want the Morgan County Sheriff's Office to proceed with your request, you will need to advance the sum of $602.00 for clerical time and copies. Please make your check payable to “Morgan County”. You may forward the payment to this office. We will not waive any fees.

Additionally, due to the fact that the requested documents may contain information that should be closed/redacted pursuant to RSMo 610.021, including but not limited to records that are protected from disclosure by law and personal identification numbers, there will be a delay in forwarding you the requested documents. I will work diligently to make sure the delay is as short as possible. Please understand that we are not refusing your request. The Sheriff is asking for your understanding and patience while we get the documents redacted.

Upon receipt of your payment and redaction by the Sheriff's Office the documents will be sent to you.

My question is that I do not want to pay for you to gather unresponsive records (i.e., email correspondence that has nothing to do with my request). So, if you are telling me that the records you will gather are, in fact, responsive to my request, then I will pay the fee. Please clarify.
