Pursuant to the Michigan Freedom of Information Act, I hereby request the following records:

A copy of any contracts for good or services that this agency has managed between the state and outside vendors. Please provide these contracts from January 1, 2015 through the date that this request is processed.

If summary versions of this data is held (such as a database or spreadsheet including vendors names, date of contract, amount, and other details), I will accept a copy of that data instead. If you believe that this request is particularly burdensome or have suggestions on ways that could provide the underlying data while reducing the burden on the agency, please let me know and I’m happy to discuss my request.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This notice is issued in response to your April 13, 2020 request (below) for information under the Freedom of Information Act (FOIA) MCL 15.231 et seq., received in the Department of Treasury (Department) on April 14, 2020.

You have requested that which you describe as “a copy of any contracts for goods or services that this agency has managed between the state and outside vendors. Please provide these contracts from January 1, 2015 through the date this request is processed. If summary versions of this data is held (such as a database or spreadsheet including vendors names, dates of contract, amount, and other details), I will accept a copy of that data instead.”

Due to the fact that we are in the midst of an extraordinary public health crisis, the Governor of Michigan has declared both a state of emergency and a state of disaster across the state of Michigan. In addition, the Governor signed executive order 2020-42, which extends her previous “Stay Home, Stay Safe” Order until April 30, 2020. On April 5, 2020, Governor Whitmer issued Executive Order 2020-38, which temporarily suspends the required response periods set forth under the FOIA, effective immediately and continuing through June 4, 2020. Section 2(a) of the Order provides that if a request requires in-person efforts, such as search, inspection, examination, preparation or production of public records, the public body may defer that portion of the request until the expiration of the order or any order that follows from it.

Section 2(b) of Executive Order 2020-38, states that if a public body defers a portion of a public records request pursuant to section 2(a) of the Order, it must explain this deferral and its reason. Pursuant to Governor Whitmer’s “Stay Home, Stay Safe” Order, Department of Treasury employees are working remotely with distinct and varied technological capabilities that impact the ability to search for, retrieve, examine and produce public records. Due to shutdowns and staff shortages related to COVID-19, the Department is unable to process your request until which time Department employees are able to return to the office and have the ability to conduct a search, review and compilation of such requested records.

Accordingly, under section 5(2)(d) of the FOIA, MCL 15.235(2)(d), and pursuant to Executive Order 2020-38, the Department will issue a written notice in response to your request no later than June 4, 2020. In the meantime, if it is determined that a portion of the records requested can be provided electronically sooner than that date, we will attempt to do so.

In response to your FOIA request, and your email below, please be informed that yesterday Governor Whitmer issued Executive Order 2020-112, which extended the suspension of FOIA deadlines through June 10. In the meantime, I would like to ask for additional clarification regarding your request.

The Department of Management and Budget (DTMB) oversees all contracts for the various state agencies. However, Treasury does have some contacts that are not available on the website as they contain information which must be redacted for security purposes. I have been in communication with the Department’s Purchasing Division to determine what information we would be able to provide. As the majority of Treasury employees are continuing to telework from home, it has been harder than usual to compile records.

To date, I can provide the following information. The Department has two contracts for collection services, one with GC Services and one with Harris & Harris. Due to redactions, and the size of the contracts, they are not on the website and also are not available electronically. I could provide you with paper copies of the contracts, totaling 1036 pages. In addition, the Department has a contract with OpSec for cigarette stamping and related services. That contract consists of 203 pages and could be provided electronically or paper copy. There may be a few additional contracts that are not listed on the DTMB site.

You stated that you are interested in contracts going back to 2015. Are you only interested in receiving information pertaining to current contracts? Or are you also looking for information pertaining to expired contracts? Our Purchasing Division is trying to determine if they would be able to compile a report of contracts, but some of the older ones are in an older database system which may be more difficult and time consuming to compile. If you require physical copies of contracts, extensive time will be required to review a number of them to see if any information must be redacted. Accordingly, a fee may be incurred.
