Pursuant to the Michigan Freedom of Information Act, I hereby request the following records:

This is a follow-up to a records request submitted on June 11, 2018 and granted by your office June 19, 2018. I am requesting any records on file subsequent to that request, including:

* Monthly salary records for former Michigan HHS employee Jose F. Aliaga (DOB 4/1977) from May 30, 2018 until his departure / termination from HHS. (Mr. Aliaga was identified as an "Assistance Payment Worker-E" in online public records, but may hold or have held other positions.)

* Copies of any applications, approvals or other documentation related to leaves of absence requested by Jose F. Aliaga subsequent to May 30, 2018 as required under Michigan Code 15.402.

*All personnel records, including any disciplinary actions or termination material, for Jose F. Aliaga as an employee of HHS subsequent to May 30, 2018 (to the extent allowed under Bradley, supra; Herald Company Inc. v. Ann Arbor Public Schools, 224 Mich. App. 266, 568 N.W. 2d 411, 1997.)

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

RE: Public Records Request, Reference # H023408-031224.

Dear Mr. Watkins,

This notice is issued in response to your request, legally received by the Michigan Department of Health and Human Services (Department) on March 13, 2024, requesting information under the Freedom of Information Act (FOIA), MCL 15.231 et seq. Your request is denied. Jose Aliaga departed state service on 04/06/2018. There are no new records for May 30th or later to add to the original request.

To the best of the Department’s knowledge, information, and belief, this Department does not possess or maintain records under the description you provided or by other names reasonably known to the Department.

As to the denial, the Department is obligated to inform you that under MCL 15.240 the following remedies are available:

1. Appeal this decision in writing to the Legal Affairs Administration, Department of Health and Human Services, Suite 207, PO Box 30037, Lansing, MI 48909. The writing must specifically state the word “appeal” and must identify the reason or reasons you believe the denial should be reversed. The Department must respond to your appeal within ten days of receipt. Under unusual circumstances, the time for response to your appeal may be extended by ten business days.

2. File an action in the appropriate court within 180 days after the date of the final determination to deny the request. If you prevail in such an action, the court is to award reasonable attorney fees, costs, disbursements, and possible damages.
