FREEDOM OF INFORMATION ACT NOTICE

Dear Ms. Riley:

The Department of State (Department) acknowledges receipt of your request for records and has processed it under the provisions of the Michigan Freedom of Information Act (FOIA), 1976 PA 442, MCL 15.231 et seq. Your request was received by the Department on March 1, 2023. This notice is issued in response to your request, a copy of which is in the email string below and incorporated herein.

You requested a list of all active commercial use agreements between the Bureau of Driver and Vehicle Programs and third parties for driver registry data as of 3/1/2023.

The Department has denied your request based on the following exemptions in FOIA Section 3: A body is not required to make a compilation, summary, or report of information, or is it required to create a new public record.

With regard to the denial of your request, under Section 10 of the FOIA, MCL 15.240, the Department is obligated to inform you that you may do one of the following:

The writing must specifically state the word “appeal” and must identify the reason or reasons you believe the denial should be reversed. The Department must respond to your appeal within ten (10) business days of its receipt. Under unusual circumstances, the time for a response may be extended by ten (10) business days.

1. File an action in the appropriate court within 180 days after the date of the final determination to deny the request. If you prevail in such an action, the court is to award reasonable attorney fees, costs and disbursement, and possible damages.
