The City of Merced (“City”) is in receipt of your request dated 12/7/2022, received by the City on 12/7/2022, in which you make a request pursuant to the California Public Records Act (Gov. Code § 6250, et seq.) for records relating to:

To Whom It May Concern: Pursuant to the California Public Records Act, I hereby request the following records: 1. the total number of use of force incidents, separated by year and type of force used from 2019-2020 (for example, information that specifies the number of taser incidents in 2020, baton incidents in 2020, etc.). 2. the total number of civilian complaints alleging any form of law enforcement misconduct that were reported and the total number sustained from 2019-2020. 3. the total number of civilian complaints alleging law enforcement use of excessive force that were reported and the total number sustained from 2019-2020. 4. the total number of civilian complaints alleging biased policing or racial profiling that were reported and the total number sustained from 2019-2020. 5. the total number of civilian complaints alleging criminal conduct that were reported and the total number sustained from 2019-2020. 6. the total number of officer involved shootings from 2019-2020, both fatal and non-fatal. When available, I would appreciate being sent individualized data for each item in this request in spreadsheet format. If individualized data are unavailable, please send information that includes aggregate statistics for the item instead. Note that my requests for civilian complaints are specifically for civilian complaints alleging police misconduct, please do not include complaints filed by one officer/the department against another officer. The requested documents will be made available to the general public, and this request is not being made for commercial purposes. In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not. Thank you in advance for your anticipated cooperation in this matter. The City takes its responsibilities as guardians of the public’s information seriously and will make its best efforts to respond to your requests within the limits of the Public Records Act. We write to inform you that the City will need an additional fourteen (14) calendar days to respond to your request. The additional time is needed to coordinate between multiple staff members and City departments, and to search for, identify and collect, and examine a potentially voluminous amount of separate and distinct records. The City will make all reasonable efforts to provide you with a written response to your request regarding which of those records sought are in the possession of the City and otherwise disclosable by no later than 1/3/2022, and at that time the City will provide you with a more exact response. Please be further aware that if the City identifies records that are disclosable, the City will need to review these records for applicable exemptions under the law, and if necessary, redact confidential, privileged, or exempt portions of disclosable records.
