Attention: Work Opportunity Tax Credit (WOTC) Unit
To Whom It May Concern:
Pursuant to the Massachusetts Public Records Law, I hereby request the following records:
1) All reports regarding Work Opportunity Tax Credits certified in 2019 and 2020 provided to the US Department of Labor, including forms 9058.
2) Any database tracking Work Opportunity Tax Credit certifications which is created or maintained by your department or by any third party vendor under contract with your department, preferably in .csv or .xlsx format. If it is easier, the database can be limited to the calendar or fiscal years ending in 2018, 2019 and 2020.
3) The most recent of any contracts with third party vendors to track WOTC certifications.
My goal is to ascertain which businesses and industries are applying for and/or receiving Work Opportunity Tax Credits, for which categories of employees and which occupations. If a conversation could help narrow or expedite the completion of this request, I am available at 802 233 4992 and emily_corwin@harvard.edu.
I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

My apologies for the delay in acknowledging these records. Thanks so much for fulfilling item #1 of my request.
I just wanted to follow up on your explanation for item #2 that you do not have a database of WOTC records. I am wondering where the information comes from that is used to populate the forms you provided me already, ETA 9058. Is there not a database which you use to aggregate that data?
In case it is helpful, I will add that the data I am seeking is received by most states in US DOL ETA forms 9061 or 9062, and are entered into a database which is then used to create ETA forms 9058. I am seeking the following fields:
business name | target group | starting wage | job position | application date | approved/denied

Please see the attached file. This responds to your public records follow-up request, dated September 28, 2021.
You requested the following information. :
"I am seeking the following fields: business name | target group | starting wage | job position | application date | approved/denied"
You have asked for the names of the employers. The names of the employers are information that the EOLWD receives from information provided to and by the Internal Revenue Service and/or the Commonwealth's Department of Revenue. Because this information comes to the Department of Revenue as "information contained in or set forth in a return or other document filed with the Commissioner," employees of the Commonwealth are prohibited from disclosing it (with exceptions not applicable here) by G.L. chapter 62C, § 21(a). Therefore, such information is defined not to be a public record by G.L. chapter 4, § 7, clause 26(a).
We are not withholding any public records based on a statutory or other legal exemption, and do not seek an extension to respond to your request. We are not charging fees for this request. If you wish to challenge any aspect of this response, you may appeal to the Supervisor of Public Records following the procedure set forth in 950 C.M.R. 32.08, a copy of which is available at http://www.mass.gov/courts/case-legal-res/law-lib/laws-by-source/cmr/. You may also file a civil action in accordance with M.G.L. c. 66, § 10A.

Hi Rosemary,
Thank you for the data you have provided and your clear explanation. Can you tell me exactly how you have determined that the business's names are delivered to you via the IRS or Commonwealth's Department of Revenue? Other states have provided me with all of these fields -- including business names -- because all of the information requested is contained in and delivered to state WOTC offices via the US DOL ETA 9061 and 9062 forms. Is there any chance there has been a misunderstanding having to do with IRS form 8850. To be clear, I am not seeking data from that form.
