Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

FY 2013 balance sheets for each each district attorney's respective special law enforcement trust fund. These trust funds, as described in MGL Chapter 94c Section 47, are funded at least in part by proceeds of asset forfeiture and the money is used to pay for law enforcement needs.

The balance sheets should include at the very minimum all deposits and disbursements from each trust fund, but please include any other data or information contained in your office's accounting records for the funds. I have requested copies of similar balance sheets from other jurisdictions in the past and they generally include the dates of all transactions, the reason for disbursements, and any case numbers associated with deposits.

I also request that all fees be waived as I am a journalist employed by the Boston Globe and therefore eligible for the news media fee exemption. Additionally, my request is in the public interest because I intend to use any pertinent information I receive as a result of this request to educate the public on the workings of the government, namely the state's asset forfeiture practices. This request should place a very small burden on your office as the relevant records are likely kept as electronic spreadsheets and should therefore be easy to locate and reproduce.

I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Mr. Feathers,

I am writing on behalf of the Department of the State Treasurer
("Treasury") in follow-up to your below public records request for the
"FY 2013 balance sheets for each... district attorney's respective
special law enforcement trust fund" per M.G.L. c.94C, s. 47.

Please be advised that upon due diligence by Treasury staff it has been
determined that the Treasury does not have any records responsive to
your request.

Through its Cash Management Department the Treasury works with
Commonwealth agencies, including District Attorneys’ Offices, to set-up
accounts with banks that are authorized through the Treasury. The
Treasury also acts as an interface with the bank by transmitting any of
the bank’s account data to the MMARS system maintained by the Office of
the Comptroller. As such, the Treasury maintains no records or account
balance sheets on behalf of the District Attorneys' Offices. Perhaps
your request would more appropriately be addressed to each individual
District Attorney's Office.

If you have any questions or concerns please feel free to contact me
and certainly feel free to reach out to the Treasury again with any
future requests.
