From: Mary Connaughton Pioneer Institute

To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

The reported Standard Occupational Classification numbers with the associated names, position titles, position type (full- or part-time), and pay of all employees for the years 2010 and 2016.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

Mary Connaughton Pioneer Institute

*Re: Public Record Request*

Dear Mary:

The Massachusetts Public Records Law (M.G.L. Chapter 66 & Chapter 4,
Section 7(26)) provides that every person has a right to access public
information. This right of access includes the right to inspect or be
furnished a copy of any public record within ten (10) *business* days
following the receipt of a request. A state agency is only required to
provide records that are in existence and is not required to create a new
record based on information in its custody to accommodate a specific
request. Under some circumstances a state agency may assess a reasonable
fee for the production of public records. Permissible charges include, but
are not limited to, fees for storage devices or materials, five cents
($0.5) per copy and personnel services. There shall be no fee for
personnel services for the first 4 hours of work performed. If more than 4
hours of employee time is required to search for, compile, segregate,
redact or reproduce the records requested, a fee may be charged at an
hourly rate equal to or less than the hourly rate attributed to the lowest
paid employee who has the necessary skill required to complete the record
request, which rate shall not exceed twenty-five dollars ($25) per hour.
Said fee restrictions may not apply when a request for records is for a
commercial purpose as determined by the Commonwealth’s Supervisor of
Records.

On August 17, 2017, the College received the attached public records
request from you. Upon reviewing this request, the College estimates that
it will take less than 4 hours of employee time to comply with your
request. Therefore, no payment is due and the College has completed your
request within the required 10 business days. If the actual costs are
greater than the estimated fee, a revised fee estimate will be issued. If
you wish to modify your request, please indicate so in writing to the
College. If you wish to appeal this estimate or you believe the College
has failed to comply with the law, you may file a petition with the
Supervisor of Records, Secretary of the Commonwealth, Public Records
Division, McCormack Building, One Ashburton Place, Room 1719, Boston, MA
02108. You may also seek judicial review by filing a civil action in
Suffolk Superior Court.

The information that you requested is attached. Please note; The data
with SOC codes for 2010 does not exist. Our Senior Director of Human
Resources was not in the position in 2010 and was unable to locate the
2010 files after an extensive search.

Sincerely,

Debbie
