Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

ll public records that relate to the following:
(1) Any prescription drug pricing or value or cost effectiveness model or other methodology employed by EOHHS and/or MassHealth to determine the proposed supplemental rebate or proposed value with respect to drug products pursuant to M.G.L. c. 118E, s. 12A, whether or not such model or methodology was developed in whole or in part by EOHHS or any third party (including without limitation the Institute for Clinical and Economic Review (“ICER”));
(2) Any communications between EOHHS or MassHealth and any third party (including without limitation ICER) that is in any way related to any methodology referenced in Paragraph (1) above;
(3) Any communications between EOHHS or MassHealth and any employee of or contractor to the Health Policy Commission that is in any way related to any methodology referenced in Paragraph (1) above; and
(4) Any communication to or from EOHHS or MassHealth concerning in any way the use of Quality Adjusted Life Years (QALYs) as a measure of health outcomes or clinical cost effectiveness relative to any methodology referenced in Paragraph (1) above.
Please exclude from the above production the disclosure of any drug product-specific or manufacturer-specific information or communications, including without limitation any drug specific methodologies or any drug-specific or manufacturer-specific rebate or price concession information or related communications.
I respectfully request that, in order to comply with this request, you require appropriate custodians to search and produce responsive records from public as well as private servers and electronic mail accounts.
If EOHHS denies the disclosure of any document responsive to this request, please provide the basis of each and every denial in accordance with 950 C.M.R. 32.06(3)(c) & (d).
Please have the appropriate person from EOHHS contact me upon the availability of the above documents. To the extent EOHHS intends to charge any fees associated with this production, please provide a written, itemized, good faith estimate of any such fees pursuant to 950 C.M.R. 32.07(2).

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records.
