From: Rachel Premack

To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

I am requesting copies of public records regarding the public funding of commercial drivers' license training programs from 01/01/2018 to 12/31/2022. These programs are designed to prepare students to meet the qualifications to become a qualified entry-level commercial truck driver. Funds for these programs were made available through the Workforce Innovation and Opportunity Act.

Specifically, I request information regarding the following:
- Budget documents for the full date range noted above, including planning documents, proposals, and research reports
- Spending reports
- Communications, including internal emails, press releases, and meeting notes and transcripts, that include the phrase "commercial drivers' license"

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, and is not made for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

Rachel Premack

Ms. Premack,
Thank you for the patience on this. The Massachusetts Department of Transportation (“MassDOT”) is in receipt of your request for public records described above. MassDOT is also in receipt of your October 29, 2023 message indicating: “You may disregard the request for ‘Communications, including internal emails, press releases, and meeting notes and transcripts, that include the phrase 'commercial drivers' license'" and please focus instead on: - Budget documents for the full date range noted above, including planning documents, proposals, and research reports - Spending reports.”
After consulting with relevant record custodians, I was informed that the Workforce Innovation and Opportunity Grants are awarded by the U.S. Department of Labor. You can follow this link to learn more about these grants: https://www.dol.gov/agencies/eta/grants. Further, the U.S. Department of Transportation's Federal Motor Carrier Safety Administration (FMCSA) awards grants for driving schools that train in CDL. You may wish to contact FMCSA for this information.
In addition, you could contact the Division of Occupational Licensure for certain responsive records by following these links: https://www.mass.gov/orgs/office-of-private-occupational-school-education and https://www.mass.gov/forms/dol-opsi-public-records-requests.
With respect to the requested spending reports, please note the RMV does not receive grant funding from the Workforce Innovation and Opportunity Act. Therefore, the RMV does not possess responsive spending reports.
Sincerely, Stephen Shorey Senior Counsel Office of the General Counsel
