Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

All documents, data, videos, including body worn cameras and police dash cameras, and audio communications to and between Malden Police Patrol Officers on on 05/19/2023 between the hours of 9:00 pm and 11:00pm (2100 and 2300 hours).

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Good Morning,

Your request has been received. However, if you are able to specify a particular incident you are looking for that would make it quicker and therefore not exceed the 2 hour window of deferred cost. In order to review any and all documents, listen to all officer calls and radio transmissions as well as review all body cam footage, it will take well over the 2 hours. As you are I’m sure aware, anything beyond 2 hours will be charged a fee of $25/hour. Before releasing any body cam footage, all video must be reviewed in its entirety in case redactions are necessary. The video alone could include several hours if video from all officers working that shift are reviewed. Please advise how you would like to go forward with this request.

Good Morning,

I have been in contact with our detective division regarding this request. There is only 1 call for service that fits the criteria in your request. That call is from an address on Salem Street in which a search warrant was executed. Any information related to that incident is currently not releasable. Therefore this request is currently being denied under exemption F (Investigatory) of the Massachusetts Public Records Law. Exemption F specifically states that “while this exemption is not a blanket exemption it applies to such information, the disclosure of which would prejudice investigative efforts. In particular, it applies to information related to ongoing investigations…” Currently, this investigation is still active and detectives are writing up another search warrant and have more witness interviews to conduct.
