Pursuant to the Maine Freedom of Access Act, I hereby request the following records:

I request access to all records relating to closed automotive claims for commercial automobile insurance. Each record should include the following elements:

- 17 digit Vehicle Identification Number (VIN) of insured

- 17 digit VIN ID of claimant(s)

- DOT/MC# of insured

- Vehicle make, model, year

- License plate number/state

- Time/date of accident

- Location of accident

- Description of accident

- Record locator/ID for filed police report

- Incurred loss value (property damage)

- Incurred loss value (bodily injury)

- Date claim closed (property damage)

- Date claim closed (bodily injury)

- Was legal suit filed?

- Was case settled or trial?

- Number of fatalities

- Number of injuries

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by 1 M.R.S.A. § 408(6). The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Good afternoon, Ms. Drubi—
Please accept this e-mail as the Bureau’s acknowledgment of your Freedom of Access Act request under 1 M.R.S. § 408-A(3) and response under Section 408-A(4).
The Bureau of Insurance does not receive the information that you have requested, except in connection with complaints filed with our agency. The general rule is that “[a]ll records of the bureau are subject to public inspection, except as otherwise expressly provided by law…” 24-A M.R.S. § 216(2). This section goes on to say that “records, correspondence and reports of investigation in connection with actual or claims violations of this Title [24-A] … are confidential.” To the extent that we have any complaints that include the information that you have requested, it would be considered confidential and therefore not subject to disclosure under the Freedom of Access Act.
