Dear Los Angeles County Board of Supervisors,

I am writing in response to the notification regarding my Public Records Act (PRA) request dated April 1, 2024, with reference number R000100-040124.

I understand that my request has been categorized as "Waiting for Clarification" status for 7 calendar days. However, I would like to address some concerns regarding the process outlined in your response.

Firstly, I must clarify that my request is made pursuant to the Freedom of Information Act (FOIA), rather than the California Public Records Act (PRA). While I acknowledge the jurisdictional nuances between the two statutes, I emphasize that my request falls under the purview of FOIA, as it pertains to federal agencies and their activities.

Secondly, I am troubled by the suggestion that failure to provide a response within the specified timeframe will result in the request being considered withdrawn and closed. It is my understanding that requesters are entitled to a reasonable opportunity to clarify and supplement their requests, as necessitated by the complexity of the information sought. Arbitrarily closing the request without affording such an opportunity would undermine the principles of transparency and accountability enshrined in FOIA.

Furthermore, I must express my objection to the requirement to review the full details of my request through the Public Records Center. While I appreciate the convenience and organization provided by such platforms, forcing requesters to navigate additional channels for accessing information may create unnecessary barriers and impede the expeditious processing of requests. Moreover, it raises concerns about privacy and security, particularly when dealing with sensitive or confidential information.

In light of the foregoing, I respectfully request that my FOIA request be processed in accordance with the procedures prescribed by the relevant federal regulations. I trust that you will give due consideration to my concerns and take appropriate action to ensure compliance with FOIA requirements.

Thank you for your attention to this matter. I look forward to your prompt response and the timely processing of my request.

Sincerely,
Evan L Rees

Good Morning:

The recently activated GovQA records processing platform is used by several government agencies and is designed as mechanism of convenience (not a requirement) for the public as it allows for the requestor to track progress, access potentially large files (when email is not capable of sending/receiving), access frequently requested records by other requestors, and has other functionalities that allow for better customer service by a government agency. It also has built-in automated responses (we are still working on customizing some of them), triggered by certain dormancies, such as the one you received. The FOIA/PRA request is never ‘closed’ or ‘deleted.’ It just gets moved under a different categorization since when there is no response from the requestor after a request for clarification. The automated confirmation cites the CPRA since we are in the State of CA, but our end goal is the same: to process a records request as efficiently and as thoroughly as possible. However, we appreciate you bringing this to our attention, as we plan on updating the automated responses to the public, so we will update the language to mention both the FOIA and CPRA.

We still have not received the clarification regarding a ‘date range.’ In addition, you stated that your request pertains to “federal” agencies and their activities. As you know, we are a local government agency (i.e. County). Are you seeking County records related to this subject matter?

Thank you,

Subject: Clarification of FOIA Request Regarding Communications with Federal Agencies & Date Range of Requested Documents

Good Morning,

Thank you for your response and clarification regarding the GovQA records processing platform. We appreciate your efforts to enhance transparency and accessibility in government operations.

To address your inquiries, our FOIA request pertains to communications between the Los Angeles Board of Supervisors and federal agencies within the specified date range of January 1, 2006, to April 15, 2024. Specifically, we are interested in any correspondence, memos, reports, or other records related to federal grants, funding allocations, legislation, or policy matters affecting Los Angeles County.

While we understand that your agency is at the local level, our use of the term "federal" refers to any interactions or communications involving federal entities. Therefore, we are requesting any records that fall within the scope of our inquiry, regardless of the level of government involved.

We apologize for any confusion and appreciate your attention to this matter. Please let us know if further clarification is needed.

Thank you for your cooperation.

Sincerely,

Evan L Rees
