Pursuant to the California Public Records Act, I hereby request the following records:

Inventory of patrol rifles (as commonly denominated for law enforcement use) and any other assault rifles (as defined in Sections 30510 and 30515 of the California Penal Code) that are owned by the agency, including: Quantity, make, model, and caliber.

If your agency does not possess records with an inventory of rifles as defined above, then we request purchase records, invoices, procurement documents and other documents sufficient to show the quantity, make, model and caliber of patrol rifles acquired by your agency since 2007.

Discussion: AB 481 required each law enforcement agency in California to post, by May 1st, 2022, inventories and use policies, including quantities, models, and costs, for rifles as defined by Sections 30510 and 30515 of the California Penal Code that the agency owned as of January 1, 2022. In searching your agency’s web site and/or searching the inventory and use policy submitted to the local governing body to comply with AB 481, we were not able to locate this information regarding patrol rifles for your agency. If your agency posted a military equipment inventory that contains this information (quantity, make, model, caliber of patrol rifles), please direct us to a functioning URL with such inventory or provide a copy of that document. We recognize that some agencies consider patrol rifles to be standard issue (and so do not include them in AB 481 policies) and some agencies do not possess patrol rifles (although most do).

We would prefer to receive an inventory of patrol rifles currently possessed by the agency. However, if your agency does not possess an inventory of patrol rifles, we are requesting records with the equivalent information, through purchase records. Other agencies have indicated that such rifles have an expected functional life of between 10 and 20 years, which is why we request such records since 2007 (again, IF the agency does not have records including an inventory of patrol rifles).

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

APPENDIX A MILITARY EQUIPMENT INVENTORY

Military equipment categories- Includes but is not limited to the following:

1. Unmanned, remotely piloted, powered aerial or ground vehicles: ICSO has drones, approximately eight (8);

2. Mine-resistant ambush-protected (MRAP) vehicles or armored personnel carriers: ICSO possesses a Bearcat armored vehicle;

3. High mobility multipurpose wheeled vehicles (HMMWV), two-and-one-half-ton trucks, five-ton trucks, or wheeled vehicles that have a breaching or entry apparatus attached: Please see #2;

4. Tracked armored vehicles that provide ballistic protection to their occupants: None;

5. Command and control vehicles that are either built or modified to facilitate the operational control and direction of public safety units: Two (2) RV's modified; one to run dispatch, one to run operations;

6. Weaponized aircraft, vessels, or vehicles of any kind: None;

7. Battering rams, slugs, and breaching apparatuses that are explosive in nature. This does not include a handheld, one-person ram: None;

8. Firearms and ammunition of_.50 caliber or greater, excluding standard-issue shotguns and standard-issue shotgun ammunition: None;

9. Specialized firearms and ammunition of less than_.50 caliber, including firearms and accessories identified as assault weapons in Penal Code § 30510 and Penal Code § 30515, with the exception of standard-issue firearms: None;

10. Noise-flash diversionary devices and explosive breaching tools: None;

11. Munitions containing tear gas or OC, excluding standard, service-issued handheld pepper spray; Tear gas and smoke grenades;

12. TASER® Shockwave, microwave weapons, water cannons, and long-range acoustic devices (LRADs): None;

13. Kinetic energy weapons and munitions: Bean bags, rubber bullets, FN303 tear gas launcher;

Patrol rifles which are standard issue. ICSO maintains approximately 100 Colt Patrol rifles which are considered standard issue.

Thank you for your response to my Public Records Act request.

My request did not concern records related to AB 481, though it did reference it. It was a request for inventory records of patrol rifles, including the number, make, model and caliber. If there are no inventory records, I requested purchase records. Your response reports an approximate number of patrol rifles possessed by ICSO, but not the model or caliber, nor an exact number.

Please let me know whether you have searched for such inventory records, as required by the Public Records Act, and if so, the outcome.
