Mr. Welch:

This email responds to your Illinois Freedom of Information Act (“FOIA”) request to the Illinois Department of Central Management Services (“CMS”) below, received by CMS on August 2, 2016, and in which you requested:

“Documents included in state Program Compliance Reviews for excess DOD personal property, typically including:

"(a) A review of each selected LEAs LESO Program Files.

(b) A review of the signed State Plan of Operation.

(c) A review of the LEA application and screener(s) letter.

-- (from "State Plan of Operation Between The State of Connecticut and the Connecticut Law Enforcement Agencies," Section VI - 'Program Compliance Reviews', § A)”
Based on an initial review, CMS has determined that your request would require the manual review and redaction of thousands of pages of potentially responsive material and, thus, as drafted, attempting to comply with this request would be unduly burdensome, as that phrase is used in section 3(g) of FOIA (5 ILCS 140/3(g)). We invite you to reduce the scope of your request to more manageable proportions by, at a minimum: (1) providing a timeframe for any requested records, specifically a period not exceeding two years, and (2) providing as much detail as possible as to the categories of records in which you seek.

To the extent that you consider this to be a denial of your FOIA request, you have the right to submit a request for review to the Public Access Counselor (“PAC”) of the Office of the Illinois Attorney General to:

Public Access Counselor
Office of the Attorney General
500 South 2nd Street
Springfield, Illinois 62706
Fax: 217-782-1396
E-Mail: publicaccess@atg.state.il.us<mailto:publicaccess@atg.state.il.us>

Any request for review to the PAC must be submitted within 60 days after the date of this letter. A request for review must be in writing, signed by you, and include a copy of your FOIA request and this response. 5 ILCS 140/9.5(a). You also have the right to seek judicial review of this response. 5 ILCS 140.11(a),(b).

Thank you.

Hello Ms. Weston,

Would limiting my request to the first two years' worth of records be sufficient? As to greater specificity, the documents I'm seeking should ideally contain the same categories of information as this response I received from Delaware's LESO: https://d3gn0r3afghep.cloudfront.net/foia_files/2016/08/26/2015_LESO_PCR_2-27-15.pdf.

Please let me know if this helps!

Thank you,
Daniel Welch

I've been unable to find an accurate date for the inception of Illinois' Program Compliance Reviews - this copy of the State Plan of Operation (https://www.illinois.gov/cms/business/surplus/Documents/fed/LESO_State_Plan033114.pdf) appears to be dated 2014, but that seems unlikely, no?

Thanks,
Daniel Welch

I do not work in our Bureau of Agency Services and have no role in the administration of the LESO program, so I cannot answer your questions regarding the program. If you want to make a follow up request, as indicated below, please be as specific as possible. For example, would you like a copy of the most recent Program Compliance Review, or are you seeking any reviews done within a certain two-year time period?
