The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The University is in receipt of your request for records pertaining to
student athlete contract disclosures given to the University regarding
student athlete name, image, and likeness activities from July 1 2021 to
October 23 2023. A longer period of time is needed to locate, retrieve, and
review the request for records. Pursuant to Idaho Code §74-102, the
University will respond to the request for records no later than 10 working
days from today, by November 14, 2023.

I am writing in response to your public records request for, "Student
athlete contract disclosures given to the University regarding student
athlete name, image, and likeness activities from July 1 2021 to October 23
2023."
An attorney for the University reviewed your request and the responsive
documents and determined that the records responsive to your request are
part of the student athletes' education records. Accordingly, they are
exempt pursuant to Idaho Code Section 74-104(1) which exempts from
disclosure any public record exempt from disclosure by federal or state law
or federal regulation. The federal law commonly known as Family Education
Rights and Privacy Act (FERPA), 20 U.S.C. § 1232g, protects student
education records from disclosure. Accordingly, your request is denied in
part.
You have a right to appeal this decision. You can appeal the denial by
instituting legal proceedings in the District Court of Ada County. Should
you choose to appeal, the petition contesting the University’s decision
must be filed within one hundred eighty (180) calendar days from the date
of this notice of denial.
By specifically listing above the grounds for exemption from disclosure,
the University does not waive any other grounds for exemption under the law.
