Hi there,

Thanks for the response. The form states: "If the records you request pertain to you, and the record is otherwise exempt from public disclosure (for example your application or testing information), you must sign this form and have your signature notarized. Other requests for public information do NOT need to be notarized." My request falls into the "other requests for public information category," which means that it does not need to be notarized. Should I interpret your response as an indication that there are no disclosable records pertaining to this licensee, since there are no disciplinary orders?

Mr. Anderson,

My apologies; you are correct. It does not need to be notarized for your request. I was responding to several requests at the same time and made a mistake.

My agency likes to have an official response for requests, but I don't want to have you fill out a request and then deny it. Complaints are not a matter of public record, and if one does constitute a violation of the Board of Psychologist Examiners laws and rules, the licensee is afforded due process and it still has to be investigated.
