Pursuant to the Idaho Public Records Act, I hereby request the following records:

The following materials regarding the imposition, assessment, collection and balances of fees and debt for incarcerated youth (i.e., juvenile):

a) All current policies and procedures regarding medical and room & board costs or fees for which incarcerated youth (i.e. juvenile) and/or their parents or legal guardians are or may become liable. Please include all policies and procedures related to how fees are set, accrued, imposed, collected, and enforced (such as those related to per diem fees, ability to pay determinations, penalties for late or non-payment, authorization for civil or criminal action for payment enforcement, etc).

b) All reports, databases, spreadsheets, or equivalent materials regarding debts/restitution paid to or owed to this department/office or any facility/agency under its jurisdiction in FY2021. Please include all relevant data regarding medical and room & board costs, including the number of youths (i.e., juveniles) charged for medical and room & board costs or fees and the total amount of medical and room & board fees imposed in FY2021.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you for reaching out to the IDJC about costs of care records. The Idaho Legislature’s intent of the Juvenile Corrections Act, as provided in Idaho Code 20-501, discusses parental accountability and monetary reimbursement for costs of care where appropriate. Idaho Code 20-524 specifically allows for IDJC to seek costs of care. However, IDJC’s practice is that we do not request the court to order costs of care (medical, boarding etc.) from juveniles or families of juveniles that are committed to the IDJC.

Idaho Code 20-501 discusses the importance of family involvement. As such we have established criteria encouraging family participation. The criteria shared below is a part of our family onboarding process and reads:

“Please be aware, Idaho law (I.C. 20-524) gives courts the discretion to order parents/custodians to reimburse the Department a reasonable sum that will cover, in part, the costs of the care and treatment your child will receive. The Court may order reimbursement at any time after your child is committed. Research has shown us that parent engagement in treatment has a positive effect on the outcome. Therefore, the IDJC will not seek reimbursement, as long as there is consistent parent/custodian involvement with your child during their treatment and collaboration with their treatment team to meet service plan goals. We look forward to a productive partnership with you.”

This practice has been in place since 2021 and courts have ordered no financial reimbursement. Therefore, we do not have records on costs of care.

Both your request under the Idaho Public Records Act and this response have been reviewed by legal counsel. The statutory exemptions provided herein shall not constitute a waiver of any and all other legal basis or privileges which may also be applicable. The denial of your request may be appealed by filing a petition in conformance with the provisions of the Idaho Public Records Act, Title 74, Chapter 1. Your petition must be filed in the Fourth Judicial District Court within 180 calendar days of the mailing of this notice.
