Your Request is being denied with respect to the Specified Records because the Specified Records are exempt from disclosure pursuant to the Illinois Freedom of Information Act, 5 ILCS 140/1 et seq., for the following specific reasons (include detailed factual basis): The city does not maintain reports for any prosecutors including prosecutors that have prosecuted any crimes that happened on September 6, 2023 in the City of Harvey. Dispatch records are maintained by the Cook County Sherriff's Office not the City. Examination data is exempt from disclosure under FOIA.
Citation to the specific section or sections of the Act containing the applicable exemption or exemptions is identified below: The Specified Records are not maintained by the Municipality, would require the Municipality to create a responsive document, or are not within the Municipality’s possession or control. § 1 The Specified Records are examination data used to determine the qualifications of an applicant for a license or employment. § 7(1)(q) The Specified Records are educational data, including test data, evaluation information, student disciplinary information, and faculty course or research materials. § 7(1)(j)

Your Request is being denied with respect to the Specified Records because the Specified Records are exempt from disclosure pursuant to the Illinois Freedom of Information Act, 5 ILCS 140/1 et seq., for the following specific reasons (include detailed factual basis): The requester requested all police reports and body cam footage for all incidents involving arrests on September 6, 2023. The City reach out to the request on February 22, 2023 to clarify if the record was related to specific incident because the amount of reports and footage for all incidents would be to burdensome for the City. The City has received no response.

Citation to the specific section or sections of the Act containing the applicable exemption or exemptions is identified below: Your Request, is categorical and unduly burdensome because the burden of complying with the Request outweighs the public interest in providing the Specified Records, and efforts to reduce the Request to manageable proportions have been unsuccessful. § 3(g)
