To Whom It May Concern:

Pursuant to the Florida Sunshine Law, I hereby request the following records:

Redacted (to protect privacy) claims-level data underlying the Hurricane Michael Claims Data summary, publicly available on this page: https://www.floir.com/Office/HurricaneSeason/HurricaneMichaelClaimsData.aspx#:~:text=Total%20Number%20of%20Claims%20in,a%20result%20of%20Hurricane%20Michael.

I understand that the data is public in summary format on the website above, but I am looking for the raw claims data (disaggregated).

I am a professor of Economics at Washington and Lee University. My research focuses on the economic impact of extreme events. I would like to request the raw insurance claims data to analyze the social and economic impacts of Hurricane Michael. Given the increasing frequency and intensity of hurricanes in Florida, the results of this research will have wide-ranging policy implications and be beneficial to the public.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days.

Sincerely,

Alice Tianbo Zhang

Good morning,

The Office of Insurance Regulation (OIR) is in receipt of your Public Records Request. If any additional information is needed, we will notify you prior to issuing a cost estimate, if applicable. We will issue an invoice for payment based upon the cost estimate, if applicable. The invoice must be paid prior to the production of any documents. Please note that the requestor's case will be closed, if the invoice is not paid within forty-five (45) days from the date of invoice. A closed case does not prohibit the requestor from resubmitting the public records request and opening a new case. It is important to note that payment must be received prior to the production of any records. For voluminous requests, a deposit is required prior to commencing the retrieval of the requested records. Upon notice of OIR's receipt of payment on the invoice, the Public Records Office will coordinate the production of records to fulfill the request. If the request includes materials that contain confidential and/or exempted information, under Florida Laws, the information shall be redacted prior to the release of any responsive documents. Please allow a reasonably sufficient time for review and redactions. Depending on the volume of requests currently pending, the timing of completion for closing this specific request may be impacted. When the production is ready, the responsive documents will be provided via email or by a secure link (the link will expire at the time specified).

If you have any questions or would like to revise your request prior to payment, please feel free to contact me.

Sincerely,

Good morning,

The Office of Insurance Regulation has nothing responsive to your request.

Hurricane loss data and associated exposure data that are specific to a particular insurance company, as reported, are exempt from s. 119.07(1) and s. 24(a), Art. I of the State Constitution per s. 627.06292, Florida Statutes.

Therefore, we do not have any releasable responsive documents.

This will complete your public records request. Please let me know if we can be of further assistance.

Good afternoon,

Most of the documents you have requested were marked "Trade Secret" by the insurer. Florida law requires that the Office notify the insurer upon receipt of a public records request for documents the insurer has marked trade secret. The insurer has 30 days following the receipt of the notice to file an action in circuit court to seek an order barring public disclosure of the document(s). The Office may not release the documents pending the outcome of the legal action. (Section 624.4213(2), Florida Statutes)

Please let me know if you wish to proceed with obtaining the Trade Secret documents.
Please response within (5) days.

Upon your response we will continue to process your request.

Good morning,

Enclosed is requested document per your request.

Trade secret has been removed from the files.

For question 1. above, we can provide the company submitted data, but we would have to remove trade secret from it, and it would be an enormous amount of data. For example, there were 33 deadlines for Irma. 500 or so companies provided data for each deadline. The last deadline had 100,000 rows of company detail data.

The estimated costs of providing the documents you have requested is $392.40 for staff time to produce. Please let me know if you wish to proceed with obtaining the above documents.

Please response within (5) days. Upon your response we will continue to process your request.

Dear Shawanda,

Thank you for your response and for sharing the requested documents.

On the company-submitted data, can you please provide more information on the variables and information contained in the files? For instance, you can share a template with the column headings and variables for only the first few rows. Or you can share the data documentation that describes the variables and measurements. Upon further information on the company-submitted data, I can decide if the documents meet the request and whether to go forward with the next steps on payment.

Thank you again for your cooperation in this matter. I look forward to receiving your response to this request within 10 business days.

Best,
Alice
