Pursuant to the Florida Sunshine Law, s. 286.011, F.S., I hereby request the following records:

I request the following records, within the time frame of 2017 to 2023. to the date on which this request is processed, and with respect to the following criteria and within the jurisdiction of the Florida Department of Health (FDOH):

1. Records that detail the consequences, ramifications, or disciplinary actions that can be taken against a healthcare facility in summation, within the context of the scope and authority of the FDOH.

2. Records that detail the precise scope of the FDOH itself as it relates to its investigative authority, power, and methods employed when investigating healthcare facilities.

3. Records, manuals, and/or guidelines that detail how the FDOH handles complaints of healthcare facilities. Additionally, I request if FDOH makes use of or employs artificial intelligence (AI) or large language models (LLMs) in the handling of either complaints or investigations into healthcare facilities.

4. Records that detail the precise scope and investigatory authority, power, methods employed (in the context of an investigation) as well as the precise extent of a Government Analyst' ability to investigate within the context of the FDOH. Additionally, I request records that detail who or whom (to clarify further, the title of such persons) has the authority or power to meaningfully conduct an investigation beyond a Government Analyst, if any such persons exist.

5. Records that detail the complete listing of agencies with which the FDOH [regularly] cooperates with as it relates to investigations into healthcare facilities.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I would also appreciate an approximate time frame for this request to be processed. Depending on the time frame for the request to be fulfilled and any fees that may be incurred, I may revise the criteria.

If you deny any part of this request, please cite each specific exemption you think justifies your refusal to release the information and notify me of appeal procedures available under the law.

I appreciate the reply! Please correct me if I'm wrong but as I understand it:

1. I believe this does indeed fall under ACHA after speaking with them.
2. I believe this still applies to the FLDOH unless the role of a Government Analyst is actually under ACHA and not the FLDOH (please correct me if I'm wrong here)
3. This still applies to the FLDOH as it as an agency has a complaints unit and thus it pertains to the policies and surrounding the handling of complaints as well as if the FLDOH makes use of artificial intelligence or artificial generative intelligence (AGI) (otherwise known as Large Language Models [LLMs]) in its handling of complaints or other operations. Some state and federal agencies do indeed make use of artificial intelligence in some capacity.
4. I realize this sounds similar to 2 but the criterion as far as 2 is separate from Government Analysts if there are any other such persons employed by the FLDOH (ie, in a more general sense) within an investigative role and thus has authority and jurisdiction as it relates to state governmental operations and the department of health.
5. This certainly still applies and it extends to ACHA and probably other agencies in regards to appraising (assessing), surveying, investigating (ie, complaints of healthcare facilities), and evaluating the operations of healthcare facilities. Again, I realize ACHA most certainly falls under this criterion (5.), but I request records regarding other agencies as well as the FLDOH itself cooperates in investigating healthcare facilities.

I specify the time frame to be from 2017 to present day, to be on the day this request is processed. I truly appreciate your help in this request and thank you in advance for clarification. I hope that I have helped clarify my request here.
