Pursuant to the Florida Sunshine Law, I hereby request the following records:

We are aware that air quality management agencies sometimes conduct "exceptional event demonstrations," which are analyses to demonstrate that emissions from potential exceptional events caused an exceedance of one or more NAAQS. These demonstrations are then submitted to the Regional EPA office in order to request that the office exclude the air quality monitoring data from use in certain regulatory determinations.

Concerning services related to these exceptional event analyses, we request:
1. Any and all executed contracts, memorandums of understanding (MOUs), or other equivalent agreements that are currently active, or have been active within the last five years;
2. Any addenda, amendments, attachments, exhibits, materials, and schedules;
3. Any and all correspondence, between the relevant air quality agency and the contracting individual, corporation, or other entity, related to the implementation of these agreements.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Hey, Dillion –

The Florida Department of Environmental Protection (DEP) has never requested that the U.S. Environmental Protection Agency exclude Florida air quality monitoring data, as influenced by an exceptional event, when determining attainment/nonattainment designations.

To better help you understand why, Florida has one of the best outdoor air quality monitoring networks in the country, designed to provide the public with accurate air quality information, and currently meets or exceeds federal air monitoring requirements per the Clean Air Act. The network is comprised of more than 177 monitors at 90 sites strategically positioned across the state. Real-time air quality data can be found on the DEP's website<https://floridadep.gov/air/air-monitoring/content/air-quality-today>, as well as the AirNow.gov<https://www.airnow.gov/> site.

In 2020, DEP announced Florida meets all National Ambient Air Quality Standards statewide and has continued to do so every year since.

This has been the culmination of several years of collaborative efforts between DEP and stakeholders to reduce emissions and improve air quality for Florida's citizens. These efforts have not only resulted in Florida continuing to have the cleanest air on record, but to its remaining the most populous state in the U.S. to meet these stringent federal standards.
