To Whom It May Concern:

Pursuant to the Florida Sunshine Law, I hereby request the following records:

All public records related to the meeting between Polk State College administrators, the Polk County Sheriff, and an Assistant State Attorney for the Tenth Judicial Circuit that occurred in February 2017 to discuss the artwork known as "Death of Innocence" by artist and Polk State College faculty member Serhat Tanyolacar.

“Public records” as defined by Florida statute 119.011(12) means all documents, papers, letters, maps, books, tapes, photographs, films, sound recordings, data processing software, or other material, regardless of the physical form, characteristics, or means of transmission, made or received pursuant to law or ordinance or in connection with the transaction of official business by any agency.

“Public records” includes, but is not limited to, any typed or handwritten notes by any attendees, e-mail correspondence before or after between actual or prospective attendees, any listing of those in attendance at the meeting that may exist, and any legal research relied upon and/or discussed at the meeting.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days.

Sincerely,

Hayden Barnes, Esq.

Mr. Barnes,

Your request for documents is considered a request for copies of the College’s public records pursuant to F.S. Chapter 119. Please let this email serve as the College’s formal acknowledgment of your public records request under F.S. §119.07(1)(c). Your request has been assigned number 2019-21. As required by law, the College will make reasonable efforts to determine whether responsive records to your request exist and will finalize your request within a reasonable time. This may require examination of responsive records for exempt or confidential and exempt information and redaction of any statutorily protected material. F.S. §119.07(4) authorizes the College to charge fees for providing duplicated copies of public records or providing extensive clerical or IT assistance in processing your request.

For your convenience and information here is a link to the College’s required disclosure for requesting public records (https://www.polk.edu/wp-content/uploads/Polk-State-College-Public-Records-Custodian.pdf). Directing such requests as indicated will ensure that they are addressed when received.

Based on our records, you made a request for substantially the same records in January 2019 which we assigned PRR# 2019-02 and fulfilled on March 1, 2019. As I indicated above we will search our records but I would expect that any records meeting this request would have been included in our response to that request.

I will be in touch with you soon to let you know (a) when you can expect the documents to be ready and (b) whether you can expect any charges for the College’s records services.

Let me know if you have any questions.
