Pursuant to the Virginia Freedom of Information Act, I hereby request the following records:

All public portions of the Department's case file on William Riddell (aka "Will" Riddell), a former high school teacher and drum corps instructor in, including but not limited to the affidavit and other supporting materials for the search warrant executed earlier this year as well as communications with Riddell's former employers, Loudoun County Public Schools and Chantilly High School.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Dear Mr. Nash:

This letter is in response to your Virginia Freedom of Information Act (VFOIA) request. You requested the following information:

"All public portions of the Department's case file on William Riddell (aka "Will" Riddell), a former high school teacher and drum corps instructor in, including but not limited to the affidavit and other supporting materials for the search warrant executed earlier this year as well as communications with Riddell's former employers, Loudoun County Public Schools and Chantilly High School."

The following exemptions are being exercised:

VA Code § 2.2-3706.1(C) Criminal investigative files relating to an ongoing criminal investigation or proceeding are excluded from the mandatory disclosure provisions of this chapter, but may be disclosed by the custodian, in his discretion, except as provided in subsection E or where such disclosure is prohibited by law.

VA Code § 2.2-3706.1(E) The provisions of subsections C and D shall not apply if the release of such information:

(1) Would interfere with a particular ongoing criminal investigation or proceeding in a particularly identifiable manner.

For the above reasons, this request is denied.
