Pursuant to the Virginia Freedom of Information Act, I hereby request the following records:

A copy of all Internal Affairs investigation reports completed between August 1, 2011 and present related to complaints filed against Fairfax County Police Officers Kenneth Bridgeman, Christopher Musser, and Andrew Pytko for misconduct by the officers on August 1, 2011.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

A portion of the fees you state are overdue are related to emails sent by Chairman Bulova's Chief of Staff, Clayton Medford, on behalf of the Fairfax County Commonwealth Attorney, Ray Morrogh.

I have made repeated requests for disclosure of an email sent by Mr. Medford to "R.Ross" at a court address. Fairfax County has admitted existence of the email but failed to cite an appropriate exemption justifying complete non-disclosure. Based on information provided in a voicemail response from the county FOIA office, the email appears to have been sent to attorney Robert Ross who is employed by a law firm which represents police officers guilty of misconduct.

As you are aware, the county may withhold public documents and cite "attorney client privilege". Fairfax County however, adopts a practice of concealing communications with attorneys in an effort to prevent the public from knowing County leaders took steps to conceal known police misconduct. Virginia FOIA does not provide an exemption for municipalities to randomly deem emails and documents "are not public documents" because they want to hide the fact that attorneys were consulted when police misconduct was brought to their attention. This practice undermines the purpose and intent of Freedom of Information laws entirely and erodes public trust.

I will make payment for the portion of released emails by Medford when I receive a response to my Ross email inquiries. Since the county has divulged that some emails were withheld, please either release those emails with necessary redactions or cite the exemption allowing complete non disclosure.
