Pursuant to the DC Freedom of Information Act, I hereby request the following records:

The following materials regarding the imposition, assessment, collection and balances of fees and debt for incarcerated youth (i.e., juvenile):

All current policies and procedures regarding medical and room & board costs or fees for which incarcerated youth (i.e. juvenile) and/or their parents or legal guardians are or may become liable. Please include all policies and procedures related to how fees are set, accrued, imposed, collected, and enforced (such as those related to per diem fees, ability to pay determinations, penalties for late or non-payment, authorization for civil or criminal action for payment enforcement, etc).

All reports, databases, spreadsheets, or equivalent materials regarding debts/restitution paid to or owed to this department/office or any facility/agency under its jurisdiction in FY2021. Please include all relevant data regarding medical and room & board costs, including the number of youths (i.e., juveniles) charged for medical and room & board costs or fees and the total amount of medical and room & board fees imposed in FY2021.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

Good Afternoon,

This is response to your FOIA request for records “regarding medical and room & board costs or fees” charged inmates in the custody of the DC Department of Corrections (DOC).

Please be advised that DOC does not charge its inmates “medical” or “room & board” fees and, therefore, requested records as regards DOC inmates do not exist. But, DOC also houses Federal inmates, and Policy and Procedure Number 2120.2D (DOC Reimbursement for Federal Prisoners) responds to your request as to Federal inmates in DOC’s custody. The policy is posted at http://doc.dc.gov/page/doc-program-statements.

If you consider this response a denial of your FOIA request, you are advised of your right under D.C. Official Code § 2-537 and 1 DCMR 412 to appeal to the Mayor or to the Superior Court of the District of Columbia.

If you elect to appeal to the Mayor, your appeal must be in writing and contain “Freedom of Information Act Appeal” or “FOIA Appeal” in the subject line of the letter as well as on the outside of the envelope. The appeal must include (1) a copy of the original request, (2) a copy of this letter, (3) a statement of the circumstances, reasons, and or arguments advanced in support of disclosure, and (4) a daytime telephone number, and e-mail and/or U.S. Mail address at which you can be reached.
