Pursuant to the DC Freedom of Information Act, I hereby request the following records:

Any policies, rules, or other similar documents outlining the practices of the DOC regarding the following:

• Hiring & recruitment
• Lateral hires of police or special police officers, including from the MPD or any other agency
• Complaints of misconduct against DOC employees
• Internal investigations into complaints of misconduct
• Disciplinary and appeal of discipline procedures
• Use of force policies, including use of deadly force
• Review of use of force policies

Please also include a copy of the current/most recent collective bargaining agreement(s) with any labor unions or similar bodies representing DOC employees.

We are seeking this information as a news media organization on a matter of public interest concerning the conduct of government. As such, we ask for a waiver of all fees because the information requested can be considered as primarily benefiting the general public D.C. Code Ann. § 2-532(b). If you do deny the fee waiver request, please do not incur fees above $100.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Pursuant to the DC Freedom of Information Act, you are seeking “policies, rules, or other similar documents outlining the practices of the DOC regarding” areas of services you itemized. Please be advised that policies of the DOC are published on its website at https://doc.dc.gov/page/doc-program-statements. Further, DOC responds to each item of your request as follows:

• Hiring & recruitment

Response: See PP 3250.1

• Lateral hires of police or special police officers, including from the MPD or any other agency

Response: Staff did not find a policy that focuses exclusively on “lateral hires of police or special police officers.”

• Complaints of misconduct against DOC employees

Response: See PPs 3300.1, 3310.4, 3320.2, and 3350.2.

• Internal investigations into complaints of misconduct

Response: See PPs 3310.4, 3350.2, 1280.2, 1440.1, and 3320.2.

• Disciplinary and appeal of discipline procedures

Response: See PPs 3320.2 and 3300.1

• Use of force policies, including use of deadly force.

Response: This policy is classified as confidential and intended for internal use. Your request for it is therefore denied pursuant to the DC Code §2-534(a)(4).

• Review of use of force policies

Response: No record identified as “review of use of force policies” was found.
You are advised of your right, under the D.C. Official Code § 2-537 and 1 DCMR 412, to appeal denial of your FOIA request to the Mayor or to the Superior Court of the District of Columbia.
