Pursuant to the California Public Records Act, I hereby request the following records:

Any and all contracts, communications, and agreements as well as contract dissolution, related to the City of Davis's partnership with the bike and electric scooter share, JUMP, later rebranded as Lime. I am interested in all contracts and agreements between January 2018 and March 2023. This includes (but is not limited to):

• all contracts (as well as associated amendments, attachments, and exhibits)
• insurance agreements
• the October 2018 City Council urgency ordinance prohibiting motorized scooter share programs in the city
• the terms of the agreement reached between SACOG and Lime for the City of Davis in 2022
• the dissolution of any such agreement between the City of Davis and Lime in 2022 or 2023

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

The City has located records responsive to your request and they are being provided to you via the City’s public records request management system, NextRequest, under the "Documents” tab.

 

The City’s search and review of potentially responsive records is ongoing.

 

Pursuant to Government Code section 7922.535(b), the City is taking a 14-day extension in which to conduct this search and review. The City reserves the right to withhold and/or redact any records or information that may be exempt from disclosure under the Public Records Act, and/or other applicable legal privileges including, but not limited to, attorney work product, attorney-client privileges, and deliberative process.

 

This response is being sent within ten (10) days of the city’s receipt of your written request, and is, therefore, a timely response under Government Code section 7922.535(a). * Government Code section 7922.000 [Deliberative Process Privilege] — authorizes a public agency to withhold an otherwise public record from disclosure when the public interest served by not making the record public clearly outweighs the public interest served by disclosure of the record. In this case, we have determined that the public interest served by not disclosing a portion of the records you have requested clearly outweighs the public interest served by disclosure of the records. (Times Mirror Co. v. Superior Court, 53 Cal.3d 1342, and 1347; Rodgers v. Superior Court, supra, 19 Cal. App. 4th at 479-480; California First Amendment Coalition v. Superior Court, 67 Cal. App. 4th 159, 170 (3 Dist. 1998))

* Government Code section 7927.500 [Preliminary drafts, notes, or interagency or intra-agency memoranda]

* Government Code section 7927.705, [Attorney Client Privilege] which exempts documents from disclosure if they are “exempted or prohibited pursuant to federal or state law.” California Evidence Code section 954 and California Code of Civil Procedure section 2018.030.

 

Because the city will not provide the exempt records, the Public Records Act requires that notification of denial of any request for records either in part or in full must include the names and titles or positions of each person responsible for the denial. See Gov. Code 7922.540(b). The person responsible for this decision is Deputy City Clerk Victor Jaimes.
